Non-fungible tokens (NFTs) have emerged as a revolutionary force in the digital landscape, transforming the way we perceive ownership, copyright, and how we exchange digital assets. 

The NFT copyright law is complete: US authorities claim

However, with their lightning-fast rise, concerns about intellectual property (IP) rights and copyright infringement have emerged. In response to these concerns, the U.S. Copyright Office and the U.S. Patent and Trademark Office (USPTO) have undertaken a joint study to assess the adequacy of existing laws in addressing copyright issues related to NFTs. 

The results of the study, recently published, state that current laws are indeed sufficient to address issues of violation of NFTs.

The comprehensive study conducted by the U.S. Copyright Office and the USPTO highlights the dynamic nature of NFT technology and its impact on the intellectual property sector. Despite the rapid evolution of NFTs, the report concludes that it would be premature to enact new specific laws for NFTs at this time. 

The focus should instead be on strengthening public education initiatives to promote greater awareness among creators, investors, and consumers.

Kathi Vidal, Under Secretary of Commerce for Intellectual Property and Director of the USPTO, emphasized the dual nature of NFTs in the intellectual property landscape. On one hand, NFTs present unparalleled opportunities for creators to leverage their intellectual property rights, while on the other hand, they pose new challenges for safeguarding their creative works. The study acknowledges the need for a nuanced approach to address these challenges without stifling innovation or hindering the potential of NFT technology.

The study of US authorities

One of the key elements that emerged from the study is that, although NFT technology introduces new concepts, the copyright issues it raises are not entirely new. In essence, the fundamental principles of copyright law remain applicable to NFTs. Therefore, cases in which NFTs incorporate or link to unauthorized copies of copyrighted works are subject to the same legal scrutiny as any other form of unauthorized reproduction or display.

The proactive stance taken by the U.S. Copyright Office and the USPTO in conducting this study underscores the government’s commitment to keeping pace with technological advancements and their implications for intellectual property rights. The study was initiated in response to a request from the Subcommittee on Intellectual Property of the Senate Judiciary Committee and reflects a collaborative effort between legislative and executive bodies to address emerging issues in the digital age.

The conclusion that existing laws are sufficient to handle NFT copyright issues has significant implications for stakeholders in various sectors. Creators can be reassured that their intellectual property rights are protected by established legal frameworks, thus encouraging innovation and creativity in the NFT space. Metabrand.tech recently collaborated with Algorand in order to certify the copyright of photographs through NFTs by leveraging blockchain technology in collaboration with photography studio BK Studios.

Metabrand.tech is an all-Italian startup that offers a consulting service for companies to use NFTs to increase their brand equity, improve customer experience and provide efficient and innovative marketing strategies. 

During the last edition of the Venice International Film Festival, BK Studios took photos of many celebrities including Timothee Chalamet, Sadie Sink, Adam Driver and British singer-songwriter and author Harry Styles (here in photo):

BK Studios is part of Brad&K Productions, one of the leading digital marketing agencies in Italy dedicated to the world of film and audiovisual entertainment, and the photos are then used not only for films but also for marketing campaigns or simply on Instagram.

The copyright of photos using NFTs

Specifically, Metabrand.tech has designed for BK Studios the Photochain platform that can certify the copyright of photos and videos as NFTs (Non-Fungible Tokens) on Algorand blockchain technology. 

Algorand’s technology was devised in 2017 by Silvio Micali, an Italian professor of mathematics and cryptography at MIT who received the Turing Prize for contributions that helped lay the groundwork for complexity theory in cryptography. Called “the green blockchain,” Algorand is carbon free and has partnerships with organizations focused on sustainability and corporate social responsibility such as ClimateTrade. Algorand is a blockchain technology that aims to be secure, scalable and decentralized. 

In addition, the Algorand platform supports tools for smart contracts and its consensus algorithm is based on proof-of-stake and the so-called byzantine agreement protocol, while ALGO is its crypto.

Metabrand.tech is, therefore, officially part of the Algorand network.

NFT and copyright

NFT stands for Non-Fungible Token: “Token” as a vessel of digital information; “non-fungible” as “non-substitutable,” meaning a unique and inimitable asset, but most importantly inviolable thanks to the blockchain that creates a digital certificate of the work, equivalent to an artist’s certificate of authenticity for his physical works.

Photochain, thus involves the use of digital tokens for a legal copyright purpose: one enters the data required to certify the copyright into a dashboard, which is then subsequently entered into the blockchain mechanism.

This results in a digital certificate of the photographic work that is unique and cannot be modified in any way: the work is protected from any attempted infringement, and the digital certificate is entered directly into the copyright holder’s wallet.
