Gala Games’ lawsuit against Spider Tanks dev Gamedia dismissed

The bizarre outcome of Dutch developer Gamedia sharing its story about the difficulties of working with blockchain game company Gala Games, was that Gala sued Gamedia.

Thankfully, though, the case has now been settled, in Gamedia’s favour, for the reason that the Central District Court of California doesn’t have jurisdiction.

Controversial proceedings have tainted Gala’s reputation for over a year now, surfacing with its token fork and burn in May 2023. As it later transpired, the burn was done in light of the ongoing lawsuit between Gala co-founders Eric Schiermeyer and Wright Thurston, to ensure the tokens Thurston was alleged to have stolen would be worthless.

This systematic pattern was later emphasised by Gamedia – which was collaborating with Gala on the launch of Spider Tanks – claiming that “all of Gala Games’ co-founders, many shareholders and many employees have been fired, bullied away, or sued”.

As part of the partnership, Gala offered Gamedia funding, promotion, and publishing support, but Gamedia soon grew concerned over Gala’s unfulfilled commitments. Gala expanded into “film and music, spending millions on fruitless celebrity partnerships, jets, and real estate” while failing in its “support, and revenue payments” to Gamedia. Following multiple failed attempts to raise these concerns with Gala, Gamedia withdrew from further investment into the game. Gala responded with legal action, public defamation, and efforts to acquire the Spider Tanks IP.

Quite where this leaves Gamedia’s PC brawler Spider Tanks, which was one of the first titles live on the Gala gaming ecosystem, is uncertain. Some think the game may turn up on another blockchain.

GALA has seen a 94% drop from its all-time high back in November 2021. The weekly chart is in a clear downtrend yet we find ourselves directly at a potential support zone. The daily time frame saw a bullish crossover of the MACD on the 20th of May but this has not led to any bullish momentum just yet. Now a bear flag has formed on the daily chart in the form of a triangle. In addition, the Bollinger Bands are contracting, suggesting that there will be increased volatility over the coming days. In that case, you do need to know the important support and resistance levels. Over to Frank!!

Spider Tanks dev Gamedia slams Gala Games: “opportunistic, greedy, and evil”

The news just keeps getting worse for web3 game platform Gala Games. Most recently Dutch game developer Gamedia has shared its story on working with the company.

In an official statement from Gamedia, which is the developer of tank brawler Spider Tanks and other titles, the team reveals a deteriorating partnership tainted by unfulfilled promises, failed revenue payments, unwillingness to cooperate, and bullying.

The initial collaboration began in early 2021, when the web3 games industry was green and Gala was seen as one of the most promising platforms in the space. Gala offered Gamedia funding, promotion, and publishing support for PC brawler Spider Tanks, while Gamedia would provide development milestones. However, fairly soon Gamedia grew concerned over Gala’s unfulfilled marketing commitments and shifting priorities.

While Gamedia “took up responsibilities like Spider Fridays, making trailers or organising events to compensate for Gala Games’ lack of resources for marketing and community engagement, Gala Games aggressively expanded into unrelated industries like film and music, spending millions on fruitless celebrity partnerships, jets, and real estate,” it states.

Continuing to experience delays in required features, support, and revenue payments, Gamedia says it made numerous attempts to address its concerns with Gala, who remained unresponsive and showed no willingness to realign and move ahead in a sustainable way.

Then by 2023, Gala announced its token fork and burn to introduce a reissued Gala v2 token. With this Gamedia says its “publisher responsibilities – such as user acquisition for Spider Tanks – were suddenly gated behind an “eat what you kill” principle”, where Spider Tanks players ended up on the losing side, being held “responsible for coughing up again what they had already contributed”.

This led Gamedia to withdraw from further investment into the game, citing Gala’s alleged mismanagement and attempts to profit from their IP. To this, Gala has responded with legal action, public defamation, and efforts to acquire their IP.

As Gamedia puts it: “Since then, Gala Games has publicly defamed us in an attempt to shift blame for their shortcomings. In their efforts to eliminate us, they have resorted to legal action and sought to unjustly take our intellectual property to further their own agenda. They have tried to portray us as opportunistic, greedy, and evil—a mere projection of their own behaviour”.

However Gala’s behaviour hasn’t just impacted Gamedia and its Spider Tanks community. The developer testifies to a pattern that’s affected multiple partners and internal teams. Other third-party developers are reportedly involved in legal disputes with Gala, while Get Plucked developer VOX is facing termination and accusations of lying, and the Mirandus team – once Gala’s signature game – was accused of being noncooperative and slow, and eventually fired.

Moreover, Gamedia claims that “all of Gala Games’ co-founders, many shareholders and many employees have been fired, bullied away, or sued”, with Gala said to be justifying its actions as being “for the greater good”.

The news seems to follow a similar pattern of activity. For example, Gala justified its 2023 token fork and burn as a way to “enhance burn mechanisms, security enhancements, and future upgradeability”. Later it transpired it was done in light of the ongoing lawsuit between Gala co-founders Eric Schiermeyer and Wright Thurston, to ensure the tokens Thurston was alleged to have stolen would be worthless.

In addition, last week it was revealed that Gala’s president of blockchain Jason Brink had formally left the company, taking with him a group of employees, to set up a new entity reportedly to support Gala from the outside, although in the light of these allegations a move which seems more like leaving a sinking ship.

A day later, Gala was hit by a $240 million exploit, by a hacker who later returned the funds, something that has only sparked more questions about the company’s structure.

GALA Token Hack – 5 Billion Tokens Minted

A recent hack on the GALA token that minted billions of extra tokens has caused a stir in the Gala community. But the Gala team responded quickly, drafting a proposal to upgrade their token contract and balance out the token supply. This proposal has already passed, and we should see the new token contract within the next couple of days.

I don’t think this was quite what Gala Games had in mind when they talk about May Mayhem! Earlier this week, someone with admin access to the GALA token contract managed to mint 5 billion fresh, new GALA tokens. They then sold a significant portion of those tokens before they were caught and their wallet shut down!

At the moment, it’s not entirely clear if this was an internal hack, or a vulnerabilitiy in the contract or company process.

This hack resulted in the minting of 5 billion (yes, billion) GALA tokens, of which approximately 600 million were sold netting a cool $20+ million for the hacker! But while 20 million sounds nice, Gala has already contacted the FBI, the DOJ, and other such authorities. So the hacker may not have long to enjoy their ill-gotten gains!

Update: Apparently the ETH from the sold tokens was recovered and is now converted back into GALA tokens.

No Worries! All is Well!

As a fix for this issue, the Gala Games team proposed to upgrade their existing GALA token contract. This upgrade will not only make the contract more secure, but it will also include a burn of about 5 billion tokens (the same exact amount minted by the hacker), by sending them to a burn address.

The proposal was only open for 24 hours. It has already passed a vote among those who own Gala Games Founder Nodes. Implementation should occur within the next few days.

And though the hack was discovered quickly, the bleeding stopped, and a proposed solution already well on its way to being implemented, this incident does highlight some of the issues with what is still a very new and ever-changing landscape of blockchain technology. Not only are smart contract audits an important part of the space, but developers also need to make sure and provide adequate security against malicious actors with access to sensitive functions (such as minting new tokens!).

And this is not the first time Gala has run into issues with their token. They already had to create an entirely new token (Gala v2), due to internal disputes among the team. And though the value of the GALA token has already rebounded from this incident, a new bloody nose for Gala Games is not going to help the growth and adoption of their blockchain ecosystem.

But, they did respond quickly, and as far as the average user knows, nothing has really changed.

What is Gala Games?

Gala Games is a produce, developer, and blockchain ecosystem for web3 gaming. This includes in-house games, as well as partnerships with other developers. Their games include Spider Tanks, Mirandus, Superior, Town Star, and many others. They also purchased Ember Entertainment, a mobile gaming company, and have begun integrating NFTs into their existing portfolio of mobile games.

But Gala includes more than just games. They have launched projects for distributing Music and Film as NFTs! Gala Games also built their own blockchain. This chain is called GalaChain (formerly GYRI), and will be the future home for all Gala-related apps and games.

Gala is a strong proponent of distributed ecosystems. And so, to support that concept, they offer user-run server nodes for both their blockchain and for many of their game as well. And, of course, they have their own token GALA, which is available on both the Ethereum network and on GalaChian.

Gala recovers following unauthorized minting of 5 billion tokens

On 21st May, Gala Games’ smart contract was exploited with the unauthorized minting of 5 billion GALA tokens, worth $240 million. The attacker then managed to exchange $21 million worth of tokens to ETH via Uniswap before the remaining tokens were frozen and burned.

Within hours of the hack, Gala CEO Eric Schiermeyer, aka Benefactor, acknowledged the incident, admitting, “We identified the compromise and within 45 minutes we secured and removed unauthorized access to the GALA contract. We messed up our internal controls… This shouldn’t have happened.”

In an unexpected turn of events, on 22nd May, the attacker returned the ETH. The company announced it would likely convert the returned ETH back to GALA tokens. Schiermeyer later confirmed on Gala’s Discord server that “We will probably buy and burn on galaswap.”

This wouldn’t be the first time GALA tokens are unexpectedly burned. In 2023, Gala was surrounded by controversy after announcing it would fork its GALA token and reissue it as GALA v2, followed by burning 42% of these new tokens. The company claimed this was to mitigate the “fundamental risk to the overall tokenomics of the project.” While the explanation seemed somewhat plausible, the token burn still raised questions at the time.

It was later revealed that Gala’s two co-founders, Eric Schiermeyer and Wright Thurston, had filed lawsuits against each other involving hundreds of millions of dollars. Schiermeyer accused Thurston of stealing and selling at least $130 million worth of GALA tokens, prompting the GALA token fork and burn to render the allegedly stolen tokens worthless.

In Thurston’s counter-suit, he alleged that Schiermeyer enriched himself at the expense of Gala Games as a company and Thurston as a co-owner, referring to Schiermeyer’s control over various assets.

In response to the recent hack, web3 investor DWF Labs demonstrated its support for Gala Games by purchasing 28 million GALA tokens to “alleviate market selling pressures“.

It’s worth noting that DWF Labs was recently in the news with Binance’s surveillance team claiming it had manipulated the price of YGG tokens and at least six other tokens, processing over $300 million in wash trades during 2023.

Despite its immediate plunge following the exploit, due to the return of funds and DWF Labs’ investment, GALA has since recovered and its price has increased by 19% in the last 7 days.

Jason Brink and his Gala allies leave, set up new org LFG

After four years at Gala Games, its president of blockchain Jason Brink (aka BitBender) has posted an official statement with his resignation, albeit to become an unpaid advisor. A few other team members are also leaving the company.

Continuing the mission to build a strong Gala ecosystem however, these former Gala employees are setting up an external organization called LFG, short for Let’s Fight Giants, which will focus on enhancing Gala’s infrastructure including GalaChain and Gala’s Node ecosystem from outside the company, in a more decentralized manner.

Brink argues this move better allows him and his allies to support external projects that are separate from Gala. Being so strongly associated with Gala Games, he reassures that “I am never going to leave the GALA ecosystem.”

Notably, in 2023 Gala forked its GALA token to reissue it as v2 GALA. While no feasible explanation was given at the time, news later surfaced about the company’s two co-founders Eric Schiermeyer and Wright Thurston suing each other for hundreds of millions of dollars. Part of the problem was the way the company had been set up to begin with, with its bylaws requiring a 2/3 majority vote for the board to act, but the company only having two equal shareholders.

To that end, Jason Brink and some of the former Gala employees leaving the actual company may prove to be a better way to support the Gala Games ecosystem.
